Requirements for Employers

  • Jobs that appear under the SOL (Shortage Occupation List)
  • Has obtained permission from the Home Office (HMO) to issue a relevant Certificate of Sponsorship
  • Employs between 20 and 250 employees
  • Employs less than 20 employees but has UKTI support
  • Is not more than 25% owned by a company which has one or more other establishments in the UK and employs more than 250 employees
  • Not established in the UK to provide services exclusively to a single company or group.
  • Has no more than ten Tier 2 (General) Migrants working for it in the same discipline – leading to a grant of leave to remain as a Tier 2 (General) Migrant
  • The British Government introduced in April 2017 an Immigration Skills Charge amounting to £1,000 per person per year of sponsorship, so under the SOL this would mean a payment of £3,000 for each overseas nurse employed
  •       Nursing migrant being sponsored must have either
    • Obtained full registration with the NMC or
    • Have passed the NMC CBT of Competence or
    • Obtained NMC permission before 30 April 2015

 

NOTE: Sponsors must retain evidence of the above in case HMO requires them.
